Terms of Service

These Terms of Service (the “Terms”) govern your access to and use of Called It (the “Service”), operated by Called It (“we,” “us,” or “our”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. What Called It is
Called It is a software interface for discovering and placing orders on event contracts. The contracts themselves are listed, matched, cleared, and settled by Kalshi, a designated contract market regulated by the U.S. Commodity Futures Trading Commission (CFTC). Called It is not an exchange, a broker-dealer, a futures commission merchant, or a bank. We do not hold custody of the contracts and do not determine market outcomes or settlement.
2. Eligibility
- You must be at least 18 years old (or the age of majority in your jurisdiction, if higher).
- You must be legally permitted to trade event contracts where you live. Event contracts are not available in all jurisdictions, and it is your responsibility to ensure your use is lawful.
- You must not be barred from using the Service under any applicable law, sanctions list, or exchange rule.
3. Not investment advice
Nothing in the Service is investment, legal, tax, or financial advice, or a recommendation to enter into any transaction. Market data, prices, sparklines, and crowd indicators are provided for information only and may be delayed or inaccurate. You are solely responsible for your own trading decisions.
4. Risk of loss
Trading event contracts involves substantial risk. Every call risks your full stake and can lose money. You should only trade with funds you can afford to lose. Past performance, streaks, or results shown in the app do not guarantee future outcomes.
5. Accounts and wallets
Authentication and your embedded wallet are provided through third-party infrastructure (including Privy and the Solana network). You are responsible for maintaining the security of your login and any wallet credentials, and for all activity that occurs under your account. Tell us immediately if you suspect unauthorized use.
6. Fees
Called It may earn a builder fee on orders routed through the Service. Any such fee is disclosed at the point of the trade and is separate from any fees charged by the exchange or the settlement network. Network (blockchain) transaction fees are not set by us.
7. Acceptable use
You agree not to: use the Service for any unlawful purpose; attempt to manipulate markets or settlement; probe, scrape, or overload our systems; circumvent geographic or eligibility restrictions; or reverse engineer, resell, or misrepresent the Service.
8. Third-party services
The Service relies on and links to third parties including Kalshi, Privy, order-routing providers, and the Solana network. Your use of those services is governed by their own terms and policies, and we are not responsible for their acts, omissions, availability, or data handling.
9. Availability and changes
We may modify, suspend, or discontinue any part of the Service at any time. We may also update these Terms; material changes will be reflected by the “Last updated” date above, and your continued use after changes take effect constitutes acceptance.
10. Disclaimers
The Service is provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, timely, secure, or error-free.
11. Limitation of liability
To the maximum extent permitted by law, Called It and its operators will not be liable for any indirect, incidental, special, consequential, or exemplary damages, or for any lost profits, trading losses, or losses of data, arising out of or related to your use of the Service.
12. Governing law
These Terms are governed by the laws of the State of [STATE], without regard to its conflict-of-laws rules. Any dispute will be resolved in the courts located in [STATE / COUNTY], and you consent to that jurisdiction.
